The accession agreement includes an act on the terms of accession of Croatia as well as on amendments to be made in the Treaty of the European Union, Treaty on the Functioning of the European Union and Treaty establishing the European Atomic Energy Community.

Under Article 49 of the Treaty of the European Union, the country who has submitted a request to accede to the Union signs an agreement with the Member States which sets out the amendments in fundamental agreements caused by the enlargement of the Union and the conditions of accessions of the applicant country. The accession agreement amends the fundamental agreements of the Union, which makes the accession agreement part of the primary law of the EU.
