Riigikogu made amendments to Technical Regulations and Standards Act
The Riigikogu passed with 76 votes in favour the Act on Amendments to the Technical Regulations and Standards Act and the Administrative Co-operation Act (415 SE), initiated by the Government. The purpose of the Act is to ensure implementation of Regulation (EC) No 764 /2008 of the European Parliament and of the Council of 9 July 2008 in the Estonian legislation. The specified Regulation deals with the principle of mutual recognition in the free movement of goods and provides the rules of procedure for creating obstacles in that regard. Pursuant to the EC Treaty, Member States of destination cannot forbid the sale on their territories of products lawfully marketed in another Member State and which are not subject to Community harmonisation, unless the technical restrictions laid down by the Member State of destination are justified on the grounds described in Article 30 of the EC Treaty, or on the basis of overriding requirements of general public importance recognised by the Court of Justice’s case law. The Act enters into force on 13 May 2009. Nobody voted against the Act and nobody abstained.
